Terms & Conditions for ELLE LA FEMME – Nail Salon (NSW, Australia)

1. Acceptance of Terms

By booking or using our services, you agree to these Terms & Conditions. If you disagree, please refrain from booking.

2. Salon Services

Services include manicures, pedicures, nail enhancements, art, and related beauty treatments. We comply with NSW regulations for beauty and cosmetic services under Australian Consumer Law and NSW health legislation.

3. Pricing & Payment

  • Prices are displayed online, via app, or in-store.
  • A $50 deposit is required to secure your booking, credited toward your total cost.
  • Final payment is due at service completion via card, cash, or EFTPOS.

4. Cancellation & Rescheduling

  • Cancellations made 48 hours or more before the appointment are fully refundable.
  • Cancellations or reschedules within 48 hours incur a non-refundable forfeiture of the $50 deposit.
  • Late arrivals (≥ 15 minutes) may result in shorter services or rescheduling, still subject to deposit forfeiture as a genuine pre-estimate of loss. 

5. Client Obligations & Health

  • Clients must disclose medical conditions, allergies, or skin issues.
  • Clients assume responsibility for informing technicians of concerns before services begin.
  • We reserve the right to refuse or modify services when safety or health standards are not met. 

6. NSW Health & Hygiene Standards

We follow strict infection control and hygiene protocols per NSW Public Health Regulation, SafeWork NSW, and council requirements.

7. Consumer Guarantees & Refunds

Consumer rights under the Australian Consumer Law (ACL) apply. If services are not delivered as promised, we will offer a remedy (redo, refund, or partial credit) in line with ACL guarantees.

8. Liability Limitation

Except for your rights under ACL, we are not liable for:

  • Delays or inability to rebook services.
  • Reactions to products used unless negligence is proven.
  • Loss or damage to personal property during your visit.

9. Privacy & Data Protection

Personal and payment information is handled under our Privacy Policy.

10. Complaints & Dispute Resolution

  • Escalate unresolved complaints to NSW Fair Trading or the Office of the Australian Information Commissioner (OAIC).

11. Changes to Terms

These Terms & Conditions may be updated at any time. Notice of amendments will be posted on our website or communicated at the salon. Continued use of services confirms acceptance.

12. Jurisdiction

These Terms are governed by NSW law. Disputes are subject to the jurisdiction of NSW courts.

Liability Waiver

By receiving services at our salon, you acknowledge and agree to the following terms:

1. Assumption of Risk

Clients understand that nail and beauty services involve inherent risks, including but not limited to skin irritation, allergic reactions, cuts, burns, infections, or damage to natural nails. By choosing to receive services, you voluntarily assume all associated risks.

2. Health & Medical Conditions

Clients are responsible for informing the technician of:
• Any allergies
• Skin sensitivities
• Medical conditions
• Recent injuries
• Use of medications that may affect the service
The salon is not liable for reactions or complications resulting from undisclosed conditions.

3. Allergic Reactions

Although we use professional‑grade products, allergic reactions can occur. The salon is not responsible for allergic responses to products or materials used during services. If a reaction occurs, we will remove the product at no charge.

4. Personal Belongings

Clients are responsible for their personal items. The salon is not liable for lost, damaged, or stolen belongings.

5. Infection Prevention

We follow strict sanitation and hygiene protocols. However, clients must follow aftercare instructions to minimise the risk of infection. The salon is not responsible for issues arising from improper aftercare.

6. Children & Guests

Children and guests are welcome but must remain seated and supervised at all times. The salon is not responsible for injuries or accidents involving unsupervised individuals.

7. Service Outcomes

Results may vary depending on nail condition, lifestyle, and aftercare. The salon does not guarantee the longevity of services if aftercare instructions are not followed.

8. Photography & Media

With your consent, the salon may take photos or videos of your nails for marketing purposes. You may withdraw consent at any time.

9. Release of Liability

By receiving services, you release the salon, its owners, employees, and contractors from any liability for injuries, damages, or losses arising from services provided, except in cases of proven negligence.
